These Terms & Conditions (“Terms”) govern participation in the Affiliate Program (“Program”) offered by MOM'S CRAZY SHOP - Lange Str. 14 - 29451 Dannenberg / GERMANY (“Company,” “we,” “us,” or “our”). By applying to or participating in the Program, you (“Affiliate,” “you,” or “your”) agree to be bound by these Terms.

1. Enrollment
1.1 To join the Program, you must complete our affiliate application.
1.2 We reserve the right to approve or reject any application at our sole discretion.
1.3 Eligibility:
- You must be of legal age in your country of residence.
- Only individuals or entities engaged in commercial activity may participate.
- You are solely responsible for ensuring that your participation complies with the commercial, tax, and business laws applicable in your home country.

2. Affiliate Responsibilities
2.1 You agree to:
- Promote our products lawfully and honestly.
- Avoid false or misleading claims.
- Comply with all applicable laws, including advertising, business, and consumer protection rules.
2.2 Prohibited activities include (but are not limited to):
- Using spam, unsolicited emails, or deceptive marketing.
- Bidding on our brand name or trademarks in paid search campaigns without permission.
- Representing yourself as the Company or pretending to be an official spokesperson.

3. Commissions
3.1 You will earn a 10% commission on the net sales amount (excluding shipping, taxes, returns, and chargebacks) from customers who purchase through your unique affiliate link.
3.2 Commissions are only earned on completed, paid, and non-refunded transactions.

4. Payment
4.1 Commission payments will be made on a monthly basis once your balance reaches minimum payout threshold $50.
4.2 Payments will be made via PayPal or bank transfer. You are responsible for ensuring your payment details are accurate.
4.3 You are responsible for any taxes or fees related to commission income.

5. Tracking
5.1 Sales are tracked using cookies and/or unique referral links provided by the Company.
5.2 We are not liable for tracking failures due to browser settings, ad blockers, or other technical issues beyond our control.

6. Term & Termination
6.1 Either party may terminate participation in the Program at any time with or without cause by providing written notice.
6.2 If you breach these Terms, your account may be terminated immediately, and any unpaid commissions may be forfeited.

7. Intellectual Property
7.1 We grant you a limited, non-exclusive, revocable license to use our logos, images, and promotional materials solely for the purpose of promoting our products under this Program.
7.2 You may not modify our branding or create misleading variations.

8. Warranties by the Affiliate
8.1 By joining the Program, you represent and warrant that:
- You are of legal age according to the laws of your home country.
- You are operating as a commercially active individual or entity.
- Your participation in the Program constitutes a lawful business activity under the laws of your home country.
- You will comply with all applicable tax, business, and regulatory obligations in connection with your participation.

9. Limitation of Liability
9.1 We are not responsible for indirect, incidental, or consequential damages (loss of revenue, profits, or data) arising from your participation in the Program.
9.2 The Company assumes no responsibility for verifying your compliance with local business registration, licensing, or tax obligations. You acknowledge that it is your sole responsibility to ensure that your participation in the Program is lawful and compliant with all applicable regulations.

10. Compliance Audit
10.1 The Company reserves the right, at its sole discretion, to request proof of your commercial activity, such as a business registration certificate, tax identification number, or other relevant documentation.
10.2 Failure to provide satisfactory evidence within a reasonable time frame may result in suspension or termination of your participation in the Program and forfeiture of unpaid commissions.

11. Independent Contractor Relationship
Participation in the Program does not create an employment, agency, or partnership relationship between you and the Company.

12. Changes to the Program
We may modify these Terms or terminate the Program at any time. Notice of changes will be provided via email or posted on our website. Continued participation after changes means you accept the updated Terms.

13. Governing Law
These Terms shall be governed by and construed under the laws of California (USA).
